Using this site, downloading our materials, or speaking with us does not create an attorney-client relationship. We are not a law firm and we do not practice law.

Real estate services and referrals

If you decide to sell real estate that is part of an estate, we may:

  • Refer you to a licensed Massachusetts real estate agent in our partner network. If you list with that agent and the sale closes, we may receive a referral fee paid by the agent or their brokerage. This fee is paid out of the agent’s commission and does not increase what you pay.
  • Make you a direct offer to purchase the property. In that case we are acting as a buyer, not as your agent, and our interests are not the same as yours. You are free to decline, to seek other offers, and to have any offer reviewed by your own attorney.

You are never obligated to list with anyone, to accept an offer, or to use any service we mention. Our free resources carry no strings.

Accuracy of information

We work to keep our materials accurate and current, but Massachusetts probate law, court procedures, and forms change. We make no warranty that the information here is complete, current, or applicable to your situation. Court filing information referenced on this site comes from public records.

Email and text messaging

If you opt in, we may contact you by email or text message about probate resources and information about selling estate property.

  • Consent is not a condition of any service.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to any text to opt out; reply HELP for help.
  • Unsubscribe from email using the link in any message.

How we handle your information, including mobile data, is described in our Privacy Policy.

Acceptable use

You agree not to use this site to break the law, to attempt to gain unauthorized access to our systems, to scrape or harvest data, or to copy and redistribute our materials commercially without permission.

Our content

The guides, checklists, and written materials on this site belong to Next Step Probate. You are welcome to download and use them for your own probate matter, and to share them with family members or your attorney. You may not resell them or republish them as your own.

Third-party links

We sometimes link to courts, agencies, and other outside resources. We do not control those sites and are not responsible for their content or practices.

Limitation of liability

To the fullest extent permitted by Massachusetts law, Next Step Probate and Jason Regan are not liable for any indirect, incidental, or consequential damages arising from your use of this site or reliance on its information. Our total liability for any claim relating to this site will not exceed one hundred dollars ($100).

Nothing in these terms limits liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute will be brought in the state or federal courts located in Massachusetts.

Changes

We may update these terms. Material changes will be reflected in the effective date above. Continued use of the site after a change means you accept the updated terms.
